A "juvenile" is the classification in most states for a person who is under the age of 18. The procedure followed when a juvenile is suspected of violating a criminal statute is very different from that used for adult offenders. While criminal law seeks a balance between punishment and rehabilitation, juvenile law favors rehabilitation. The juvenile criminal justice system presumes that there is a fundamental difference between minors and adults in terms of their level of responsibility and potential for rehabilitation; as such, the primary goal is the successful reintegration of the minor into society, while maintaining overall public safety.
However, in the unfortunate event that a juvenile is arraigned, the court may decide to send him/her to adult criminal court. The court will also decide whether the minor will be detained or allowed to go home for the time period before the initial hearing. Having an experienced juvenile criminal lawyer is critical when these decisions are being made. Furthermore, we have observed that the District Attorney is less likely to be lenient or give good deals when the opposing counsel is not experienced in juvenile law. The D.A.'s ultimate goal is to convict as many people as possible; often innocent people are overzealously punished and incarcerated.
At Inhouse Co, we have a team of Orange County juvenile lawyers who not only specialize in this delicate area of the law, but who have a successful track record of achieving non-incarceration solutions, such as placement of the minor in rehabilitation programs, payment of restitution to victims, imposition of court-imposed curfews, mandatory school attendance, or placement in a juvenile detention facility. The judgments made at this crux in the minor's life can very often determine his/her path well into adult life; the election of a skilled and specialized attorney is crucial.
